Final Settlement in Blood Reagents Antitrust Litigation Approved by Court
On October 24, 2018, in In re Blood Reagents Antitrust Litigation, a nation-wide price-fixing case against the major U.S. suppliers of blood reagents, in which Spector Partners was appointed Class Counsel for direct purchaser plaintiffs, e.g., American Red Cross, hospitals, blood banks, labs, U.S. District Court Judge Jan DuBois (E.D. Pa.) gave final approval to a settlement with defendant Ortho-Clinical Diagnostics, Inc. totaling $19.5 million. Combined with the previously approved settlement with defendant Immucor, Inc., Spector Partners achieved settlements totaling $41.5 million for direct purchasers of traditional blood reagents, a medical necessity. This settlement concludes the litigation, which has been pending since May 2009. Judge DuBois praised Spector Partners’ efforts, noting that the “lawyering in this case was nothing short of superb,” and that Spector Partners partner Jeffrey Corrigan’s work was “excellent” and made Judge DuBois’ job “so much easier.”
